In response to the request for developing an employment law compliance plan from Traci, my learning team selected Landslide limousine service based out of Austin, Texas to develop their compliance plan. We were told there planning for a beginning workforce of 25 employees within your first business year. This organization has a great plan to provide first-rate limousine services to their area and as long are they are careful to follow some of the basic laws and guidelines that my team has discovered during the week building our individual compliance plans.
We both chose to go with the small business option of landslide limousine services and through online and course material research we have, we have found many areas that could cause issues with the initial hiring phase of the organization. After conducting research on the labor laws that apply to this business, I chose the four most important laws to discuss in the memo: Occupational Safety and Health Act, Consumer Credit Protection Act, Fair Labor Standards Act, and Uniformed Services Employment and Reemployment Rights Act. These were chosen due to the nature of the business, applicability, and the effect on the employer’s hiring decisions.
Since the business nature of Landslide Limousines is a transportation and customers’ safety should be the number one priority, the OSH Act is the most important law for this business to comply with as violations of this law have the potential to shut down operations. Second, the FLSA is important because it applies to just about every business in the US and its territories, and it also helps employers set up the framework for employee wage scales and work schedules. The next most important law is USERRA. Texas has one of the highest military populations in the country so knowledge of employee rights under USERRA is vital when hiring from the local population. Finally, the CCPA prevents employers from discharging an employee for incurred debt that must be repaid through the garnishment of wages. This is important from an employer’s standpoint since an employee in financial trouble has the potential to become a liability to the business owner, especially if the employee directly handles payment for service from the customer.
After compiling some of the basic laws and responsibilities that this new organization will have to develop and implement our team now will have a better understanding of this basic framework to set this organization for a successful future.
