I. THE DEFENDANT SHOULD HAVE SOUGHT PERMISSION FIRST
Mr. Gillis, the defendant, is a mash-up artist who has, without authorization or payment,
appropriated a portion of the song Sunday Bloody Sunday and mashed it up to produce his ‘This
is the Remix’ song. Section 106 of the copyright law (Title 17 of the United States Code) gives
the copyright owners of the work of authorship the authority to use and authorize the use of their
work (17 U.S.C. § 106). This section also gives the copyright owner the exclusive right to
perform and authorize the performance of copyrighted sound and music public. In this case, the
defendant neither sought authorization nor informed Blue Mountain Music Group that he
intended to use the copyrighted work.
